A Grant of Probate, also known as a Grant of Letters of Administration if a person dies without a Will, is the document which is required to deal with the assets of someone who has died.
Upon death, the assets and debts of the deceased have to be valued to form their estate, which is then distributed in accordance with the deceased’s wishes as stated in their Will or under the Rules of Intestacy, if there is no Will.
In order to obtain the legal authority to administer the estate, the executors of the Will have to apply for a Grant of Probate. Where there is no Will, a Grant of Letters of Administration will have to be applied for by the person entitled to do so under the Intestacy rules, to enable them to deal with the estate.
